The rules governing the use of AtlasSIM, our virtual number platform for receiving verification SMS.

1. Acceptance of the terms

By creating an account on AtlasSIM, purchasing a virtual number, or in any way using the services accessible from the atlas-sim.org website or our associated applications, you acknowledge that you have read, understood and unreservedly accepted these Terms of Service (the "Terms"). These Terms constitute a legally binding contract between you, the user ("you", the "User"), and AtlasSIM ("we", "us", the "Company", the "Platform").

If you do not accept these Terms in full, you must immediately stop using the Platform and refrain from creating an account. Continued use of the service after any amendment to the Terms constitutes acceptance of the new provisions. If you use AtlasSIM on behalf of a company or another legal entity, you represent that you have the authority to bind that entity to these Terms.

These Terms apply to all features offered by AtlasSIM: purchase and rental of virtual numbers, receipt of verification SMS, management of the prepaid balance, payments via Mobile Money, PawaPay and cryptocurrencies through Cryptomus, as well as any future feature added to the Platform.

2. Description of the service

AtlasSIM offers a service of temporary or long-term virtual phone numbers, allowing you to receive verification SMS (OTP codes, sign-up confirmations, two-factor authentication) for more than 1,500 online services and third-party applications, across more than 180 countries. The service operates on a prepaid model: the User tops up a balance on their account, then purchases numbers individually according to the desired country and service.

AtlasSIM acts as a technical intermediary. We are neither the telecommunications operator that owns the numbers, nor the provider of the third-party services (social networks, messaging platforms, marketplaces, etc.) for which the User wishes to receive a verification code. The numbers made available come from telecommunications partners and SMS virtualization providers (including OnlineSim) with whom AtlasSIM maintains contractual relationships.

The availability of numbers, countries and services is updated continuously but may change without notice depending on the technical, regulatory or commercial constraints of our partners. AtlasSIM reserves the right to add, modify or remove countries, services or features at any time, without this engaging its liability towards Users.

3. Account creation and security

Access to most of AtlasSIM's features requires creating an account, providing a valid email address and a password. You agree to provide accurate, complete and up-to-date information when registering, and to keep it up to date throughout your use of the service. Only one account is permitted per individual or legal entity, unless expressly agreed in writing by AtlasSIM.

You are solely responsible for the confidentiality of your login credentials and for any activity carried out from your account, whether or not authorized by you. You agree to inform us immediately, at support@atlas-sim.org, of any unauthorized use of your account or any breach of the security of your credentials.

AtlasSIM reserves the right to request additional identity verification (confirmation email, payment method verification) in the event of suspicious behavior, an attempted fraud, or a legal obligation, particularly in the context of anti-money laundering efforts. Refusal to provide the requested information may result in the temporary or permanent suspension of the account.

4. Pricing, balance and payment

The prices of virtual numbers are expressed in US dollars (USD) and displayed in the User's preferred currency for indicative purposes only, before actual conversion at the time of payment. Rates vary depending on the country, the requested service and the real-time availability of numbers, and may change at any time without notice for future purchases, with no retroactive effect on transactions already completed.

AtlasSIM operates on a prepaid balance model: the User tops up their account via the available payment methods (Mobile Money via PawaPay, cryptocurrencies via Cryptomus), and the amount corresponding to the purchased number is then automatically debited from that balance at the time of order. The balance is neither a bank account nor a savings or investment product: it represents a usage credit that can only be spent on the Platform.

Every top-up is final, subject to our refund policy described in the dedicated document. AtlasSIM does not charge any monthly subscription fee: the model is entirely based on pay-as-you-go usage. Conversion or network fees specific to the chosen payment provider (Mobile Money, blockchain) may apply and remain the User's responsibility, independent of AtlasSIM's will.

5. Use of numbers

Each purchased number is made available for a set duration (a single-use number to receive one SMS, or a rented number for a period defined in days). The User must use the assigned number within the time window indicated at the time of purchase: after this period, the number is automatically released and returned to the pool of available numbers.

A number remains the exclusive property of AtlasSIM's telecom partner or technical provider. The User only benefits from a temporary, non-exclusive right of use: the same number may be reassigned to another user after the rental period. It is therefore strictly forbidden to use an AtlasSIM number as a permanent identifier for account recovery or as a durable contact number with third parties.

The User acknowledges that AtlasSIM does not guarantee that the expected SMS will necessarily arrive within the allotted time, as receipt depends on factors beyond our control (anti-fraud filtering by the third-party service, network congestion, geographic blocking). In the event of non-receipt, our automatic refund policy described in the dedicated document applies.

6. Prohibited uses

Use of AtlasSIM is strictly regulated. In particular, the User is prohibited from:

• Using the Platform for illegal, fraudulent purposes or purposes contrary to public order, including creating mass fake accounts in violation of third-party services' terms of use (spam, phishing, identity theft).

• Circumventing, disabling or disrupting the security measures, rate limiting or fraud detection systems implemented by AtlasSIM or its partners.

• Reselling, sub-letting or commercially redistributing access to virtual numbers without prior written authorization from AtlasSIM, including via unauthorized API services.

• Using automated scripts, bots or data extraction tools (scraping) to interact with the Platform outside of any officially documented API.

• Carrying out money laundering, terrorist financing operations, or any activity intended to conceal the origin of funds via the payment methods offered by AtlasSIM.

• Using the numbers to harass, threaten or harm a third party, or to create accounts intended to disseminate illegal content (child exploitation material, incitement to hatred, terrorist content).

• Attempting to fraudulently obtain a refund, in particular by falsely claiming non-receipt of an actually received SMS, or by repeatedly submitting abusive refund requests.

Any violation of these prohibitions may result in immediate suspension of the account, forfeiture of the remaining balance, and a report to the competent authorities where required by law or where AtlasSIM deems it necessary to protect its users and partners.

7. Fraud prevention and anti-money laundering (AML)

AtlasSIM applies reasonable due diligence procedures to prevent the Platform from being used for financial fraud or money laundering purposes. This includes automated transaction monitoring, detection of unusual payment patterns (repeated amounts, suspicious geographic changes, multiplication of accounts linked to the same payment method) and, where applicable, the temporary freezing of funds pending verification.

Our payment providers, PawaPay for Mobile Money transactions and Cryptomus for cryptocurrency payments, apply their own regulatory know-your-customer (KYC) and anti-money laundering obligations, in accordance with the applicable legislation in their respective jurisdictions. AtlasSIM may be required to transmit information relating to a transaction to these providers or to the competent authorities as part of their legal obligations.

In the event of a reasonable suspicion of illegal activity, AtlasSIM reserves the right to suspend an account, withhold a balance during the investigation, and refuse any refund until the situation is clarified. The User agrees to cooperate in good faith with any reasonable request for information made in this context.

8. Availability and no guarantee of receipt

AtlasSIM implements reasonable means to ensure the continuous availability of the Platform, but does not guarantee uninterrupted, error-free or delay-free access. Planned interruptions (maintenance) or unplanned interruptions (technical incidents, outages at our infrastructure providers such as Cloudflare or Supabase) may occur without engaging AtlasSIM's liability beyond the refunds provided for in our dedicated policy.

The actual receipt of a verification SMS depends on multiple factors beyond AtlasSIM's direct control: anti-fraud policies of third-party services, congestion of local telecom networks, geographic restrictions imposed by certain operators, or sudden changes in filtering rules by the receiving service. AtlasSIM therefore cannot guarantee 100% receipt of an SMS for a given service or country.

In the event of non-receipt within the contractual period displayed at the time of purchase, the User benefits from the automatic refund mechanism described in our refund policy, which constitutes the sole and exclusive contractual compensation provided for this type of incident.

9. Termination and suspension

The User may, at any time, stop using the Platform and request the closure of their account by contacting support@atlas-sim.org. Closing the account does not automatically result in a refund of the remaining balance, unless otherwise provided for by our refund policy or by an applicable legal obligation in the User's jurisdiction.

AtlasSIM reserves the right to suspend, restrict or terminate a User's access to the Platform, with or without notice, in the event of a breach of these Terms, proven or suspected fraudulent behavior, non-payment, or a request from a competent authority. In the most serious cases (established fraud, illegal activity), termination may be immediate and the balance forfeited as compensation for damages caused to AtlasSIM or third parties.

In the event of termination without fault on the User's part, the User may request a refund of the unused balance according to the terms and delays described in our refund policy, subject to prior verification of the absence of abuse.

10. Limitation of liability

To the extent permitted by applicable law, AtlasSIM's total liability towards a User, for any cause whatsoever (contractual, tortious or other), is limited to the total amount actually paid by that User during the twelve (12) months preceding the event giving rise to the damage. AtlasSIM shall under no circumstances be liable for indirect, incidental, special or consequential damages, including loss of profits, data or business opportunities.

AtlasSIM disclaims any liability for the consequences resulting from the User's use of a virtual number with a third-party service, including the suspension of a third-party account, the refusal of a service, or any consequence linked to that third-party service's own terms of use, over which AtlasSIM has no control.

The Platform is provided "as is" and "as available", without warranty of any kind, express or implied, including merchantability, fitness for a particular purpose or non-infringement, to the extent permitted by applicable law.

11. Intellectual property

All elements making up the AtlasSIM Platform (brand, logo, graphic design, source code, database, textual and visual content) are protected by intellectual property law and remain the exclusive property of AtlasSIM or its licensors. Nothing in these Terms shall be construed as transferring any intellectual property right to the User.

The User benefits from a personal, non-exclusive, non-transferable and revocable right of use, limited to the normal use of the Platform in accordance with its purpose. Any reproduction, substantial extraction, reverse engineering or unauthorized commercial exploitation of the Platform's elements is strictly prohibited and may result in legal action.

The trademarks and logos of the third-party services for which verification numbers are offered (social networks, messaging platforms, etc.) belong to their respective owners and are mentioned for purely informational and descriptive purposes, without implying any partnership or official affiliation unless explicitly stated otherwise.

12. Changes to the Terms

AtlasSIM reserves the right to modify these Terms at any time, in particular to reflect regulatory, technical or commercial developments. Any material change will be the subject of reasonable notice, by posting on the Platform and/or by email to the address associated with the User's account, at least fifteen (15) days before it takes effect, whenever materially possible.

The "last updated" date at the top of this document is authoritative. Continued use of the Platform after the changes take effect constitutes full acceptance of the new Terms. If the User does not accept the proposed changes, it is up to them to stop using the service and, where applicable, close their account according to the terms set out in Section 9.

13. Governing law and dispute resolution

These Terms are governed by the law applicable at AtlasSIM's place of registration, without prejudice to any mandatory consumer protection provisions that may apply in the User's country of residence. In the event of a dispute, the User is invited to first contact our support team at support@atlas-sim.org in order to seek an amicable resolution within a reasonable timeframe.

Failing an amicable resolution within sixty (60) days, any dispute relating to the validity, interpretation or performance of these Terms shall be submitted to the competent courts, subject to mandatory jurisdiction rules applicable to consumers that cannot be excluded by contract.
